How Discharge Status Affects VA Burial Eligibility

A veteran’s discharge status can play a crucial role in determining what burial benefits are available. Many families assume that all veterans automatically qualify for VA burial benefits, but that’s not the case. Understanding how different discharge types affect eligibility ensures families can access what they’re entitled to — even in less-than-ideal situations.

Why Discharge Status Matters

The VA generally requires that a veteran’s discharge be honorable or under honorable conditions to qualify for burial benefits, including:

  • Burial in a VA national cemetery
  • Burial allowance reimbursements
  • Grave markers or headstones

Discharges that are less than honorable — such as general under honorable conditions, other-than-honorable (OTH), bad conduct, or dishonorable — may limit or disqualify benefits.

Eligibility by Discharge Type

  • Honorable / General (Under Honorable Conditions): Full eligibility for VA burial benefits
  • Other-Than-Honorable (OTH): VA may review the case individually; some benefits may still be available
  • Bad Conduct or Dishonorable: Generally ineligible for VA burial benefits, except in rare situations (e.g., deaths in VA care)

It’s important to note that eligibility isn’t always black-and-white. The VA can make exceptions depending on circumstances, such as:

  • Veteran was receiving VA benefits at the time of death
  • Death occurred while in VA care
  • Posthumous upgrades of discharge status

What Families Should Do

  1. Verify Discharge Status – Review the veteran’s DD Form 214 carefully.
  2. Check for Upgrades – Some veterans may qualify for a discharge upgrade, which can restore burial benefits.
  3. Gather Documentation – Include service records, VA medical records, and any supporting evidence.
  4. Contact the VA or a VSO – Veteran Service Organizations can guide families through eligibility reviews and claims.

Even if a veteran’s discharge is less than honorable, it’s worth exploring the VA’s review process — benefits may still be accessible.
